JCT 2005 / SBCC 2005 – all change or much the same?
CDR has recently completed another presentation to a major Scottish Local Authority on the use of the new JCT 2005 / SBCC 2005 suite of contracts. The event was held over 2 days and aimed to provide an in depth, comparative analysis of the key features of the 2005 contracts with the now familiar 98 versions.
The CDR team covered the major changes in relation to time related provisions, design liability, payment provisions and procedure, together with dispute resolution. Coverage included a full review of the practical issues, pitfalls, contract defaults and how to address them in day to day situations.

Mediation as an ADR Solution
Janey Milligan and Kahleen Crawford of CDR recently considered this point in making a presentation to the Institution of Civil Engineering Surveyors (ICES).
Mediation is gaining in popularity, and with it’s inclusion in the JCT 2005 and SBCC 2005 suite of contracts and the introduction of Sheriff Court Pilot Schemes, it seems set to continue to grow as a method of dispute resolution.
CDR’s presentation looked at the application of mediation to construction disputes, considering whether it works, the role of the mediator, the process itself and its advantages and hazards. Recent Case Law and the UK’s apparent reluctance to embrace Mediation were also appraised.
The Presentation was very well received and both Janey and Kahleen’s professionalism and commitment were particularly picked out for praise by the Regional Chairman of ICES. In addition, an article on the topic will appear in the next ICES Journal.

6th Annual CDR prize awarded
Since 1994, the University of Strathcyde has provided Masters (LLM) and Postgraduate Diploma (PgDip) courses in Construction Law. CDR has sponsored the Dispute Resolution module of the LLM course for the past six years and is delighted to award the CDR prize for the best student in this area of law.
Construction law is constantly changing and dispute resolution is often a central theme in its development through case law and legislation. The law of construction is often therefore specialised and complicated.
Isobell Griffiths, of law firm Biggart Baillie, became the 6th recipient of the Construction Dispute Resolution Ltd. prize, awarded annually on the recommendation of the Chairman of the Law School for the best student in the Dipsute Resolution module.

Cash for Kids Lunch 1 December 2006
Construction Dispute Resolution were delighted to ably support Radio Clyde’s Cash for Kids Appeal 2006 by hosting a table at the Lunch held in The Hilton, Glasgow on the 1st December 2006.
The festive season and party season got off with a bang for CDR and guests at the Cash for Kids first 2006 Celebrity Lunch. Over 700 people were entertained by Michele McManus, G4, Orson, Angelis and the event was closed by Glasgow band Big Vern 'n' The Shootahs.
In total the first Cash for Kids Lunch raised an amazing £256,000 and CDR is once again delighted to have been associated with this very worthy cause.
